South Australia has one regulatory system for education and early childhood services. This is set out in legislation: the Education and Early Childhood Services (Registration and Standards) Act 2011 (SA), which incorporates the Education and Care Services National Law (South Australia).  

This work is carried out by the Education Standards Board (ESB), having been appointed by His Excellency, the Governor of South Australia, to do so.

This legislation captures community expectations and standards for all children’s services and schools, both government and non-government:

The ESB has the following key functions:

  • regulating the provision of education services and early childhood services
  • approving the requirements for endorsement of registration of schools
  • establishing and maintaining the registers contemplated by this Act
  • preparing or endorsing codes of conduct for registered schools
  • providing advice to the Minister
  • carrying out other functions assigned to the Board by the Minister.

As a designated state authority, we assess and recommend schools for registration on CRICOS (Commonwealth Register of Institutions and Courses for Overseas Students) in line with Commonwealth legislation:
