Type of action: Cancellation of service approval pursuant to s. 79 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the service approval in relation to the risks posed to the safety, health and wellbeing of a child or children being educated and cared for and the service failing to comply with the conditions on its service approval.

The matters giving rise to the cancellation included:

  • Appointment or engagement of family day care coordinators pursuant to s. 163
  • Protection of children from harm and hazards pursuant to s. 167
  • Adequate supervision of children pursuant to s. 165
  • Requirement to keep enrolment and other documents pursuant to s. 175
  • Required programs pursuant to s. 168
  • Requirement to keep a register of family day care educators pursuant to s. 269.

Details of action: The Registrar of the Education Standards Board issued a compliance notice in relation to failing to comply with certain provisions of the National Law. The matters giving rise to the compliance notice being issued included:

  • Failure to ensure every reasonable precaution is taken to protect children being educated and cared for by the service from harm and from hazard likely to cause injury

Details of action: The Registration Standards Board issued an enforceable undertaking in relation to allegations that the provider has contravened a provision of the National Law. The matters giving rise to the enforceable undertaking being issued included:

  • Failure to provide for adequate qualified staffing arrangements
  • Failure to keep required documents such as staff records.

The approved provider has provided evidence that they have complied with the provisions of the National Law and Regulations in relation to the compliance notice.

Details of action: The Registrar of the Education Standards Board cancelled the service approval in relation to the risks posed to the safety, health and wellbeing of a child or children being educated and cared for and the service failing to comply with the conditions on its service approval. The matters giving rise to the cancellation being issued included:

  • Protection of children from harm and any hazards pursuant to s. 167
  • Staffing arrangements pursuant to s. 169
  • Requirement to keep enrolment and other documents pursuant to s. 175
  • Required program pursuant to s. 168.

The Registrar cancelled the provider approval due to the unacceptable risk posed to the safety, health and wellbeing of a child or children being educated and cared for by any education and care service operated by the approved provider.

Details of action: The Registrar of the Education Standards Board suspended the service approval without show cause in relation to the immediate risks posed to the safety, health and wellbeing of a child or children being educated and cared for. The matters giving rise to the suspension being issued included:

  • Service not being managed in accordance with the Law pursuant to s. 70(c)
  • Failure to comply with the previous compliance notice issued pursuant to s. 70(f)
  • Requirements for policies and procedures to be followed pursuant to r. 170

Details of action: The Registrar of the Education Standards Board imposed additional conditions on the service approval in relation to the service failing to comply with certain provisions of the National Law.

Conditions imposed:

  • That the service approval for Farah 4 Kidz Family Day Care Service is limited to a maximum of 30 educators, with a ratio of 1 coordinator to 15 educators, or part thereof
  • That Farah 4 Kidz (SA) is limited from operating in any other jurisdiction or territory.

The matters giving rise to the imposition of additional conditions included:

  • Adequate supervision pursuant to s. 165
