Type of action: Cancellation of provider approval pursuant to s. 33 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the provider approval in relation to failing to comply with certain provisions of the National Law. The matters giving rise to the cancellation being issued included:

  • approved provider or a person with management and control of the education and care service operated by the approved provider is  not a fit and proper person to be involved in the provision of an education and care service pursuant to s. 31(a)
  • continued provision of education and care by the approved provider would constitute an unacceptable risk to the safety, health and wellbeing of any child being educated and cared for by any education and care service operated by the approved provider pursuant to s. 31(b)
  • approved provider breaching a condition of the provider approval pursuant to s. 31(e).

In accordance with the National Law any service approval held by the approved provider is also cancelled.

Type of action: Cancellation of provider approval pursuant to s. 33 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the provider approval in relation to failing to comply with certain provisions of the National Law. The matters giving rise to the cancellation included:

  • approved provider or a person with management or control of an education and care service operated by the provider is not a fit and proper person to be involved in the provision of an education and care service pursuant to section pursuant to s. 31(a)
  • continued provision of education and care services by the approved provider would constitute an unacceptable risk to the safety, health and wellbeing of any child or class of children being educated and cared for by the education and care service operated by the approved provider pursuant to s. 31(b)
  • breach of a condition of the approved provider pursuant to s. 31(e).

In accordance with the National Law any service approval held by the approved provider is also cancelled.

Kids in Care Family Day Care

Approved provider: Kindness Care Pty Ltd

Type of action: Cancellation of service approval pursuant to s. 79 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the service approval in relation to the unacceptable risk to the safety, health or wellbeing of children being educated and cared for and continued failure to comply with certain provisions of the National Law. The matters giving rise to the cancellation being issued included:

  • protection of children from harm and hazards pursuant to s. 167
  • failure to comply with the previous compliance notice issued pursuant to s. 70
  • appoint or engage family day care coordinators pursuant to s. 51
  • keep prescribed enrolment and other documents pursuant to s. 175
  • required programs pursuant to s. 168
  • keep a register of family day care educators pursuant to r. 153
  • children’s attendance records to be kept by family day care educator pursuant to r. 159
  • residents at family day care residences to be fit and proper persons pursuant to r. 163
  • requirements for policies and procedures to be followed pursuant to r. 170
  • evidence of prescribed insurance pursuant to r. 180.

Precious Family Day Care

Type of action: Cancellation of provider approval pursuant to s. 33 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the provider approval in relation to failing to comply with certain provisions of the National Law. The matters giving rise to the cancellation being issued included:

  • approved provider or a person with management and control of the education and care service operated by the approved provider is  not a fit and proper person to be involved in the provision of an education and care service pursuant to s. 31(a)
  • continued provision of education and care by the approved provider would constitute an unacceptable risk to the safety, health and wellbeing of any child being educated and cared for by any education and care service operated by the Approved Provider pursuant to section 31(b)
  • Approved provider breaching a condition of the provider approval pursuant to section 31(e).

In accordance with the National Law any service approval held by the approved provider is also cancelled.

Type of action: Cancellation of service approval pursuant to s. 79 of the National Law

Details of action: The Registar of the Education Standards Board cancelled the provider approval in relation to the approved provider not operating an education and care service for a period of more than 12 months.

In accordance with the National Law any service approval held by the approved provider is also cancelled.

Sunshine Early Learning Family Day Care Service

Type of action: Cancellation of provider approval pursuant to s. 33 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the provider approval in relation to failing to comply with certain provisions of the National Law. The matters giving rise to the cancellation issued included:

  • approved provider or a person with management and control of the education and care service operated by the approved provider is not a fit and proper person to be involved in the provision of an education and care service pursuant to s. 31(a)
  • continued provision of education and care by the approved provider would constitute an unacceptable risk to the safety, health and wellbeing of any child being educated and cared for by any education and care service operated by the approved provider pursuant to s. 31(b) 
  • breach a condition of the approved provider pursuant to s. 31(e).

In accordance with the National Law any service approval held by the approved provider is also cancelled.
