AAA Family Day Care Service

Approved provider: Yownata Pty Ltd Trustee for Abetew Family Trust

Date of action: 10/3/2016

Type of action: Cancellation of service approval pursuant to s. 79 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the service approval in relation to the risks posed to the safety, health and wellbeing of a child or children being educated and cared for and the service failing to comply with the conditions on its service approval. The matters giving rise to the cancellation being issued included:

  • adequate supervision pursuant to s. 165
  • protection of children from harm and hazards pursuant to s. 167
  • required programs pursuant to s. 168
  • requirement to keep enrolment and other documents pursuant to s. 175
  • register of family day care educators pursuant to s. 269
  • assistance to family day care educators pursuant to s. 164.

The provider approval was cancelled effective 10/11/2017.

Type of action: Suspension of Service Approval without show cause pursuant to s. 73 of the National Law 

Details of action: The Registration Standards Board suspended the service approval without show cause in relation to the immediate risks posed to the safety, health and wellbeing of a child or children being educated and cared for. The matters giving rise to the suspension being issued included:

  • adequate supervision pursuant to s. 165
  • protection of children from harm and hazards pursuant to s. 167
  • required programs pursuant to s. 168
  • requirement to keep enrolment and other documents pursuant to s. 175
  • register of family day care educators pursuant to s. 269
  • assistance to family day care educators pursuant to s. 164.

Early Childhood Development Family Day Care

Approved provider: Early Childhood Development Family Day Care Pty Ltd

Address: 32 John Street Salisbury SA 5108

Date of action: 13/6/2016

Type of action: The Registrar of the Education Standards Board cancelled the provider approval in relation to failing to comply with certain provisions of the National Law.

Details of action: The matters giving rise to the cancellation being issued included:

  • approved provider or a person with management and control of the education and care service operated by the approved provider is  not a fit and proper person to be involved in the provision of an education and care service pursuant to section 31(a)
  • continued provision of education and care by the Approved Provider would constitute an unacceptable risk to the safety, health and wellbeing of any child being educated and cared for by any education and care service operated by the Approved Provider pursuant to section 31(b)
  • approved Provider breaching a condition of the provider approval pursuant to section 31(e).

In accordance with the National Law any service approval held by the approved provider is also cancelled.

Fantastic Family Day Care

Approved provider: Fantastic Family Day Care Pty Ltd

Address: 4/165 Woodford Road, Elizabeth North SA 5113

Date of action: 2/6/2016

Type of action: The Registrar of the Education Standards Board imposed additional conditions on the service approval in relation to the service failing to comply with certain provisions of the National Law. 

Conditions imposed:

  • that the service approval for Fantastic Family Day Care service is limited to a maximum of 25 educators
  • that the approved provider is to ensure the equivalent ratio of 1 coordinator to 15 family day care educators be maintained at all times (noting that if educator numbers are between 16 and 25 this will require 2 coordinators at all times).

Details of action: The matters giving rise to the imposition of additional conditions included:

  • protection of children from harm and from hazards pursuant to s. 167
  • required program pursuant to s. 168
  • requirement to keep enrolment and other documents pursuant to s. 175
  • unauthorised person on the education and care service premises pursuant to s. 170.

Fun Field Family Day Care

Date of action: 25/1/2016

Type of action: Cancellation of service approval pursuant to s. 79 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the service approval in relation to the risks posed to the safety, health and wellbeing of a child or children being educated and cared for and the service failing to comply with the conditions on its service approval.

The matters giving rise to the cancellation included:

  • protection of children from harm and hazards pursuant to s. 167
  • required programs pursuant to s. 168.

Fun Field Family Day Care

Date of action: 12/10/15 to 12/01/16

Type of action: Suspension of  service approval without show cause pursuant to s. 73 of the National Law

Details of action: The Registrar of the Education Standards Board suspended the service approval without show cause in relation to the immediate risks posed to the safety, health and wellbeing of a child or children being educated and cared for. The matters giving rise to the suspension being issued included:

  • protection of children from harm and hazards pursuant to s. 167
  • required programs pursuant to s. 168
  • adequate supervision of children pursuant to s. 165
  • appointment or engagement of family day care coordinators pursuant to s. 163
  • assistance to family day care educators pursuant to s. 164
  • requirement to keep enrolment and other documents pursuant to s. 175
  • requirement to keep a register of family day care educators pursuant to s. 269.

Honey Bee Family Day Care

Type of action: Cancellation of service approval pursuant to s. 79 of the National Law

Details of action: The Regulatory Authority cancelled the service approval in relation to the unacceptable risk to the safety, health or wellbeing of children being educated and cared for and continued failure to comply with certain provisions of the National Law. The matters giving rise to the cancellation being issued included:                       

  • adequate supervision pursuant to s. 165
  • appointment or engagement of family day care coordinators pursuant to s. 163
  • protection of children from harm and hazards pursuant to s. 167
  • required programs pursuant to s. 168
  • requirement to keep enrolment and other documents pursuant to s. 175
  • register of family day care educators pursuant to s. 269.

Type of action: Compliance direction issued pursuant to s. 176 of the National Law

Details of action: The Registrar of the Educaton Standards Board issued a compliance direction in relation to failing to comply with certain provisions of the National Law.  The matters giving rise to the compliance direction being issued included:

  • failure to take reasonable steps to ensure that the education and care service provides education and care to children in a way that encourages children to express themselves and their opinions, allows the children to undertake experiences that develop self-reliance and self-esteem, maintains at all times the dignity and rights of each child; gives each child positive guidance and encouragement toward acceptable behaviour; and has regard to the family and cultural values, age, physical and intellectual development and abilities for each child being educated and cared for
  • failure to take reasonable steps to ensure that the service provides children being educated and cared for with opportunities to interact and develop respectful and positive relationships with each other and with staff members of, and volunteers at, the service.

The approved provider has provided evidence that they have complied with the provisions of the National Law and Regulations in relation to the compliance notice.

    Teenzone: Novita Outside School Hours Care

    Type of action: Compliance notice issued pursuant to s. 177 of the National Law

    Details of action: The Registrar of the Education Standards Board issued a compliance notice in relation to failing to comply with certain provisions of the National Law. The matters giving rise to the compliance notice being issued included:

    • Protection of children from harm and hazards pursuant to s. 167.
    • Fail to notify certain information to the Regulatory Authority pursuant to s. 174
    • Education and care service must have policies and procedures pursuant to r. 168

    The approved provider has provided evidence that they have complied with the provisions of the National Law and Regulations in relation to the compliance notice.

    YMCA of South Australia

    Approved provider: YMCA of South Australia Inc.

    Date of Action: 10/10/2016

    Type of action: Enforceable undertaking pursuant to s. 179(a) of the National Law and Compliance Direction pursuant to s. 176 of the National Law

    Details of action: The Registrar of the Education Standards Board offered the approved provider to enter into an enforceable undertaking in relation to failing to comply with provisions of the National Law and Regulations. The Registrar also issued a compliance direction relation to failing to comply with provisions of the National Law and Regulations.

    The  matters giving rise to the compliance action being issued included:

    • Education and care service must have policies and procedures pursuant to r. 168
    • Requirement to operate education and care service with a nominated supervisor pursuant to s. 161.

    The approved provider has provided evidence that they have complied with the provisions of the National Law and Regulations in relation to the compliance notice.
