Type of action: Cancellation of provider approval pursuant to s. 33 of the National Law

Details of action: The Registrar of the Education Standards Board cancelled the provider approval in relation to failing to comply with certain provisions of the National Law.

The matters giving rise to the cancellation being issued included:

  • Approved provider or a person with management and control of the education and care service operated by the approved provider is not a fit and proper person to be involved in the provision of an education and care service pursuant to s. 31(a)
  • Continued provision of education and care by the approved [rovider would constitute an unacceptable risk to the safety, health and wellbeing of any child being educated and cared for by any education and care service operated by the Approved Provider pursuant to s. 31(b)
  • Approved provider breaching a condition of the provider approval pursuant to s. 31(e).

In accordance with the National Law any service approval held by the approved provider is also cancelled.

Type of action: Suspension of service approval without show cause pursuant to s.73 of the National Law

Details of action: The Registrar of the Education Standards Board suspended the service approval without show cause for 61 days in relation to the immediate risks posed to the safety, health and wellbeing of a child or children being educated and cared for.

The matters giving rise to the notice to suspension being issued included:

  • Protection of children from harm and any hazards pursuant to s. 167
  • Staffing arrangements pursuant to s. 169.

  • Protection of children from harm and any hazards pursuant to s. 167
  • Staffing arrangements pursuant to s. 169.

Date of action: 14/12/2018

Type of action: Compliance notice pursuant to s. 177 of the National Law

Details of action: The Registrar of the Education Standards Board issued the approved provider with a compliance notice in relation to failing to comply with provisions of the National Law and Regulations.

The matters giving rise to the notice being issued included:

  • Protection of children from harm and hazards pursuant to s. 167
  • Health, hygiene and safe food practices pursuant to r. 77
  • Premises furniture and equipment to be safe, clean and in good repair pursuant to r.103
  • Furniture, materials and equipment pursuant to r. 105
  • Storage of records and other documents pursuant to r.183

The approved provider has provided evidence that they have complied with the provisions of the National Law and Regulations in relation to the compliance notice.

Type of action: Emergency action notice pursuant to s. 179 of the National Law

Details of action: The Registrar of the Education Standards Board issued an emergency action notice in relation to the immediate risks posed to the safety, health and wellbeing of a child or children being educated and cared for.

The matters giving rise to the emergency action notice being issued included:

  • Protection of children from harm and any hazards pursuant to s. 167
  • Emergency and evacuation procedures pursuant to r. 97.

The approved provider has provided evidence that they have complied with the provisions of the National Law and Regulations in relation to the compliance notice.
